Welcome to The Bennett Family. By making a purchase on our website, you agree to the following Terms and Conditions ("Terms"), which govern your access to and use of this site and all sales contracts between you ("the Customer") and NSproducts, trading as The Bennett Family ("the Seller").
1. Scope of application
1.1 These Terms apply to all sales of products through the official The Bennett Family website at thebennettfamily.com. Any conflicting terms proposed by the Customer are not valid unless expressly approved in writing by the Seller.
1.2 These Terms apply to both individual consumers and professional buyers.
1.3 Use of this site constitutes full acceptance of these Terms.
2. Formation of the contract
2.1 Product descriptions on the site are for informational purposes and do not constitute a binding offer.
2.2 A sales contract is formed once the Customer completes the checkout process and receives an order confirmation email from The Bennett Family.
2.3 If a product is unavailable, the Seller will notify the Customer within 5 business days and issue a full refund.
2.4 The Seller reserves the right to refuse or cancel orders that appear suspicious or fraudulent, or that contain incomplete information.
3. Prices and payment
3.1 All prices are displayed and processed in US dollars (USD).
3.2 Any sales tax, import duties, or customs fees applied by U.S. Customs and Border Protection or other authorities are the responsibility of the Customer. These may be requested by the carrier at the time of delivery.
3.3 Shipping costs are calculated and displayed at checkout.
3.4 Accepted payment methods include major credit and debit cards, PayPal, Shop Pay, and any other methods shown at checkout. All transactions are processed over secure encrypted connections.
4. Shipping and delivery
4.1 Orders are processed within 1 to 3 business days.
4.2 Estimated delivery to the United States takes 7 to 14 business days after dispatch.
4.3 Customs and duties. Products are shipped on Delivered Duty Unpaid (DDU) or Delivered At Place (DAP) terms. The Customer is responsible for any import costs or duties that apply.
4.4 If we are unable to dispatch an Order within the time stated above, we will notify the Customer and offer the choice of a revised delivery date or cancellation with a full refund.
5. Returns and cancellations
5.1 Return period. The Bennett Family offers a 30-day return policy from the date of delivery.
5.2 Exceptions. The right to return does not apply to personalized items or to hygiene-sensitive products once any hygiene seal has been removed.
5.3 Return shipping. Return shipping costs are the responsibility of the Customer, except in cases of a proven manufacturing defect, damage in transit, or an incorrect item being sent.
5.4 Refunds. Approved refunds are issued to the original payment method within 3 business days of our receiving and inspecting the return.
5.5 Cancellations. An Order may be cancelled free of charge at any time before dispatch.
6. Warranty and liability
6.1 Products are provided with the standard warranty of conformity.
6.2 To the extent permitted by law, the liability of The Bennett Family is limited to the purchase price of the product.
6.3 Nothing in these Terms limits any right the Customer has under mandatory consumer protection law that cannot be waived.
7. Intellectual property
All site content, including logos, text, images, and designs, is the property of The Bennett Family or its licensors. Reproduction or use without express written authorization is prohibited.
8. Governing law and jurisdiction
8.1 These Terms are governed by the laws of the Netherlands, where the Seller is established.
8.2 Any dispute arising from these Terms will be submitted to the competent court in the Netherlands, unless mandatory consumer protection law in the Customer's jurisdiction provides otherwise.
